Terms of Use

Last updated: 23 October 2026

These Terms form a binding agreement between you and the individual developer who publishes QCode ("we", "us"), covering the QCode application and the services at qcodeapp.com and api.qcodeapp.com. By downloading or using QCode you accept them. If you do not accept them, do not use QCode.

Two things worth reading before anything else. QCode is provided as is, with no warranty, and we are not liable for lost code or lost data — keep your own backups. Running code sends that file to our servers; do not run anything you are not permitted to disclose.

Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use QCode on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not redistribute the app, sell or sublicense access to it, rent it out, reverse-engineer it except where that right cannot lawfully be excluded, remove notices from it, or extract credentials, keys or tokens embedded in it.

We reserve every right not expressly granted here. These Terms grant you no rights in our trademarks, name or branding.

QCode Studio subscription

QCode is free to download and includes a Hobby tier. QCode Studio is an optional auto-renewing subscription.

Purchases are made through Apple and are subject to Apple's terms. Refunds are handled by Apple; we cannot issue them directly and have no access to your payment method. Where a free trial is offered, any unused part of it is forfeited when you purchase a subscription.

We may change the price of a subscription. A price change takes effect no earlier than the next renewal period, and Apple will seek your consent where required; you may cancel before it applies.

Tier limits

The Hobby tier is limited to a fixed number of local projects, a fixed number of files per project, and a daily number of code runs, each shown in the app. GitHub Codespaces and git sync require Studio. We may change these limits; where a change materially reduces what a paid subscription provides, it takes effect at your next renewal, and you may cancel before then.

Your code and content

You keep all rights to the code and files you create with QCode. We claim no ownership of your content and acquire no licence to it beyond what is technically necessary to run it at your request and return the output.

You are responsible for your content, for having the right to use it, and for keeping your own backups. See our Privacy Policy for what happens to a file when you press Run, and for what the AI assistant sends to OpenAI.

Acceptable use

You agree not to use QCode or our servers to:

We may suspend or terminate access that breaches this section, immediately and without refund, and we may report unlawful activity to the competent authorities.

Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless against claims, losses and reasonable legal costs arising from your content, your use of QCode in breach of these Terms, or your violation of law or of a third party's rights. This does not apply to claims caused by our own breach, and nothing in it affects your rights as a consumer.

Third-party services

QCode can connect to GitHub, uses OpenAI for its assistant, and is distributed through Apple. Your use of those services is governed by their own terms, and we are not responsible for them, for their availability, or for what they do with data you send them.

Availability

We aim to keep the service available but do not guarantee uninterrupted or error-free operation, and we offer no service level agreement. Capacity is shared: runs may be queued or rejected at busy times, and execution carries time and memory limits.

We may change, suspend or discontinue any part of the service, including languages and runtime versions. If we permanently discontinue a feature that is material to a paid subscription, you may cancel through Apple, and we will not renew your subscription against your wishes.

No warranty

QCode and the services are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law. We do not warrant that the service will meet your requirements, that output will be correct, or that code you run will behave as you expect.

Output of the AI assistant is generated and may be wrong. Review it before relying on it. You remain responsible for any code you ship.

Limitation of liability

To the fullest extent permitted by law, we are not liable for lost or corrupted code or data, lost profits, lost business, loss of goodwill, or any indirect, incidental, special, consequential or punitive damages, however caused and on any theory of liability, even if we were advised of the possibility.

Our total aggregate liability for all claims relating to QCode is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or ten euros.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for gross negligence or wilful misconduct. If you are a consumer, your mandatory statutory rights are unaffected, and nothing here requires you to waive them.

Termination

You may stop using QCode at any time and cancel a subscription through Apple. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we cease to offer the service. Sections that by their nature should survive termination — licence restrictions, indemnity, warranty disclaimers, limitation of liability and governing law — survive it.

Changes to these Terms

We may update these Terms. The date at the top reflects the current version, and material changes will be signalled in the app. If you continue to use QCode after a change takes effect, the updated Terms apply. If you do not accept them, stop using QCode and cancel any subscription.

Governing law and disputes

These Terms are governed by the law of the Slovak Republic, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The courts of the Slovak Republic have jurisdiction.

If you are a consumer resident in the European Union, you keep the protection of the mandatory consumer law of your country of residence, and you may bring proceedings in the courts there. The European Commission also provides an online dispute resolution platform for consumers.

General

If any provision is held unenforceable, the rest remains in force and that provision is applied as closely as possible to its original intent. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a transfer of the app. These Terms, together with the Privacy Policy and Apple's own terms, form the entire agreement between us about QCode.
